Korea's 52-hour week: legal working hours and overtime, night and holiday pay

You hear “the 52-hour week” all the time in Korea, but it is easy to get muddled about which hours actually count. This is general information based on Korea's Labour Standards Act as of 2026. The rules can differ by company size, industry and working arrangement, so for your own situation check with the Ministry of Employment and Labour helpline (1350 within Korea) or a certified labour attorney (nomusa).
52 hours is 40 plus 12
The legal working time, excluding breaks, is 8 hours a day and 40 hours a week. If employer and employee agree, you can work up to 12 more hours a week. That is overtime, and the two together make 52 hours, the most you can work in one week.
A “week” here means seven days including days off, so hours worked on a Saturday or Sunday count towards the 52. According to the Supreme Court, the 12-hour overtime cap is judged by hours over 40 in the week, not by adding up each day's hours beyond eight.
Breaks don't count as working time
An employer must give at least a 30-minute break during 4 hours of work, and at least an hour during 8 hours. Breaks are yours to use freely, so they are not working time. Start at 9:00, finish at 18:00 with an hour for lunch, and you have worked 8 hours. On the other hand, time spent waiting at your desk on the company's instructions does count as work.
An amendment passed by the National Assembly in May 2026 will let someone working a 4-hour shift leave without the 30-minute break if they explicitly ask to. It takes effect six months after promulgation, so check the exact start date.
Working out your own week
Taking out an hour for lunch and assuming five days a week:
| Schedule | Weekly hours | Overtime | Verdict |
|---|---|---|---|
| 9:00–18:00 | 40 h | 0 h | Standard hours |
| 9:00–20:00 | 50 h | 10 h | Within the cap |
| 9:00–18:00 + 6 h on Saturday | 46 h | 6 h | Within the cap |
| 9:00–21:00 | 55 h | 15 h | Over the 12 h cap |
Overtime, night and holiday work pay 50% extra
Overtime, night work (22:00 to 6:00 the next morning) and holiday work must be paid at least 50% on top of ordinary wages. For holiday work, the first 8 hours get 50% extra and anything beyond 8 hours gets 100%. Overtime that is also night work gets both premiums. However, holiday work is paid at the holiday rates above and does not get a second overtime premium on top, even when it takes the week past 40 hours.
| Type | Premium | Pay per hour |
|---|---|---|
| Overtime | 50% | 22,500 won |
| Overtime at night | 100% | 30,000 won |
| Holiday work, first 8 h | 50% | 22,500 won |
| Holiday work beyond 8 h | 100% | 30,000 won |
The ordinary hourly wage is usually the monthly base pay divided by 209 hours. Where that 209 comes from is explained in counting down to home time and turning a salary into an hourly rate.
The exceptions
- Fewer than five employees: the hour limits and the overtime, night and holiday premiums don't apply. The break rules still do.
- Special industries: land, water and air transport, other transport-related services and healthcare can go beyond 12 hours of overtime with a written agreement with employee representatives, but must give at least 11 hours of consecutive rest between shifts.
- Flexible hours: under flexible or selective working-time schemes, a week over 40 hours is judged by the average across the agreed period.
- Others: agriculture and fisheries, approved surveillance or intermittent work, and supervisory or managerial roles are exempt from the hour rules, and under-18s have tighter limits.
Why it pays to keep a record
Claiming overtime pay or checking whether the cap was exceeded comes down to when you actually started and finished. Even if there are door logs or work messenger records, a note you make every day is far easier to rely on later. Even under an all-inclusive pay contract, you may be owed the difference if you really worked more hours than it assumes.
Checking today's hours in Offwork
Enter your start, lunch and finishing times and your work days in Offwork, and it shows the time until home time as a gauge with a second-by-second countdown, along with “worked today”, your hours so far with lunch taken out. It doesn't total your week or work out overtime or night pay, so note each day's hours and add them up yourself. You can get an alert at finishing time, or 5, 10 or 30 minutes before, and everything you enter is saved only in your browser. The interface is in Korean.
